LEGAL SERVICES

Assisted Reproduction Agreements and parentage orders

We prepare ovum (egg) donation, sperm donation, embryo donation, and gestational surrogacy agreements.  We also represent gestational surrogacy clients in actions for declarations of parentage (sometimes called birth orders or pre-birth orders although they cannot be procured prior to birth in all U.S. jurisdictions).  In addition, we assist foreign clients in obtaining citizenship for their newborns in their countries of origin.

BIOETHICS RESEARCH

We provide bioethics research to lawmakers, the media, and medical facilities and practices.

We also advise clients who are seeking to become fertility tourists in places such as India, Thailand, and the former Soviet Union. We review clinic agreements, represent clients at the at the surrogacy ageement phase, and assist clients in bringing their child(ren) back to their home country and having their child(ren) receive the citizenship of his/her/their parents.

We provide bioethics and legal research to lawmakers, medical facilities and medical practices including fertility clinics and hospitals, and the media. We prepare expert testimony and amicus briefs. We are available for media interviews.

RISK MANAGEMENT

We offer comprehensive risk management services.

For individuals and couples, we clarify clients’ financial obligations by assessing and helping them understand their economic risk in entering into third party reproductive agreements.  Accordingly, we review their agreements with ovum (egg) donation and gestational surrogacy agencies whose services they also may be engaging.  In addition, in surrogacy cases, we examine the health insurance policies of potential gestational carriers for surrogacy exclusions, i.e. clauses denying pre-natal care and delivery coverage to gestational carriers, and, in cases where there are such exclusions, assist gestational carriers, intended parents, and gestational surrogacy agencies to find alternatives including negotiated fee arrangements with hospitals and physicians.  When necessary, we identify suitable life and short- and long-term disability insurance. We assist with estate planning documents for intended parents and healthcare powers of attorney for gestational surrogates.  We also examine proposed fertility tourism plans and provide advice on local clinics, travel logistics, and insurance.

For institutional, governmental, and lawmaker clients, we assess the state of legal practice in multiple jurisdictions and evaluate proposed third party reproductive legislation. For legal practitioners involved in third party reproductive litigation, we perform legal research and prepare amicus briefs.
